Here you will find the legally binding version of our German terms and conditions. Below you will find a free translation into English, given only as a courtesy. Please note: only the German version of the terms and conditions are binding.

Allgemeine Geschäftsbedingungen

Wir sind LGBT-friendly. Wir legen Wert auf Werte wie Toleranz, Transparenz, Offenheit und Ehrlichkeit. Gleichzeitig sind uns Diskretion und Vertrauen wichtig. Erlauben Sie uns ein paar klare Worte, um Missverständnisse zu vermeiden und lassen Sie uns gemeinsam für einen angenehmen Start in einen tollen Aufenthalt sorgen.

Check-in
Check-in ist standardmäßig um 18.00 des Anreisetages (nicht "irgendwann ab 18.00 Uhr). Auf Nachfrage sind ggfs auch buchbar ein early-Check-in zwischen 15.00 und 18.00 Uhr, ein super-early-Check-in zwischen 12.00 und 14.59 Uhr sowie ein late-Check-in bis 21.00 Uhr mit individueller Uhrzeit. Den Check-out am Abreisetag bestimmen Sie bis zur Maximal-Uhrzeit spontan und flexibel für sich selbst.

Wir haben keine Rezeption und meist Folge-Check-in-Termine an anderen Orten in Berlin. Nach 15min verlassen wir den Check-in-Ort wieder. Daher soll der Check-in auch ausdrücklich zur vereinbarten Uhrzeit (fix) stattfinden. Ungeplante Wartezeiten bedeuten meist eine zweite Anfahrt und einen deutlichen zeitlichen Mehraufwand. Um eine neue Check-in-Uhrzeit zu vereinbaren, nutzen Sie bitte die Handynummer, die in der Reservierungsbestätigung und im Impressum angegeben ist. Ein/e zweite/r Check-in-Versuch/-Termin/-Anfahrt wird mit mind. 25€ berechnet.

Berlin ist sehr groß. Bitte planen Sie daher Ihre Anreise, Ihre Bahnfahrt, Ihre Flugzeiten etc. so ein, dass Sie zum Check-in vor Ort sein können. Abweichende Ankunftszeiten sind bei öffentlichen Verkehrsmitteln i. d. R. nicht erst am Anreisetag bekannt. Berücksichtigen Sie dieses bei Zug- und Flugbuchungen sowie bei Ihrer Routenplanung mit dem Auto. Verspätete Ankunftszeiten mit dem Auto werden nicht erst zur Check-in-Uhrzeit erkannt.

Gäste
Unangemeldete Gäste sind: Gästewechsel, Mehrpersonen und jeglicher Besuch (auch nicht temporär) im Apartment sind nicht gestattet. Unangemeldete Gäste (egal ob "nur" zum Besuch, zum "nur mal Schauen", "nur zum Abholen", "nur auf ein Gläschen" oder zur Übernachtung usw.) werden pro Kalender-Tag und pro Person nachträglich mit 150€ pro Person pro Tag berechnet. Wir wünschen absolut keine Mehrpersonen, die nicht bereits mit der Anmeldung oder vor dem Check-in zahlenmäßig genannt wurden. Mehrpersonen können nicht nachgemeldet (Anmelden und/oder Nachmelden mit dem Betreten der Lokation ist definitiv zu spät und nicht akzeptiert) werden. Unangemeldete Personen berechtigen uns, ohne Anmeldung die Location zu betreten und unser Hausrecht auszuüben. Unser Hausrecht auszuüben bedeutet, die Location zu betreten und Hausverweise aussprechen zu dürfen.

Gleiches gilt, wenn Personen ein Hausverbot bereits ausgesprochen bekommen haben. Diesen ist es nicht erlaubt, die Lokation zu betreten. Geschieht dieses dennoch, üben wir unser Hausrecht aus und betreten die Lokation. Wir haben das Recht, dann Hausverbote und/oder weitere Hausverbote gegenüber dem buchenden Gast und seinen Begleitungen/weiteren Gästen mit sofortiger Wirkung auszusprechen. In diesen Fällen besteht kein Anspruch auf Schadenersatz im Rahmen des Buchungsumfanges. Der buchende Gast hat selbst, da wir seine Gäste nicht in jedem Fall vorab kennen, sicherzustellen, dass seine Begleitungen und anderen Gäste nicht ein bestehendes Hausverbot erhalten haben.

Wir weisen darauf hin, dass ein Verstoß gegen ein Hausverbot juristisch eine Straftat im Sinne eines Hausfriedensbruches darstellt, was weitere Folgen nach sich zieht.

Keine Personen unter 18 Jahren, keine Untervermietung, keine Fremdevents oder -parties. Das BDSM-Loft ist keine Prostitutionsstätte. Daher ist die Anbahnung, Durchführung und Entgegennahme sexueller Dienstleistungen in unseren Räumen nicht gestattet (vgl.ProstSchG §2).

Praktiken – Hart aber herzlich
Sicherheit und Hygiene haben bei uns und für unsere nächsten Gäste einen allerhöchsten Stellenwert. Der Cleaningaufwand ist in wenigen bestimmten Fällen für uns nicht vertretbar. Darum verzichten wir ausdrücklich auf Wachs/Kerzen, Haustiere, Drogen, Wetplay (Urin), Natursekt (Urin), Squirten sowie Koprophilie/bekannt als Scat oder Kaviar. Personen unter 18 Jahren sind nicht erlaubt. Die jeweilige Nichtbeachtung wird mit 200€ berechnet und ist nicht verhandelbar!

Reinigungs-Mehraufwand
In der Küche und dem zivilen Schlafzimmer hinten darf gar kein Öl und Gel jeglicher Art (auch nicht auf dem Boden z. B. durch Fußabdrücke oder auf dem Bett) verwendet werden. In allen anderen Räumen sollten die Verunreinigungen in der Summe weniger als 2 Quadratmeter ( z. B. auf dem Jailhouse-Fuck-Bed, der Slingmatte und Fußboden) betreffen. Beim Equipment und anderen Gegenständen (z. B. auch Masken, Fesseln, Türen, Regale, Möbel) sollte es sich um Einzelfälle von maximal 10 Gegenständen handeln. Leider müssen wir hierfür sensibilisieren, da der Reinigungsaufwand sonst nicht mehr in einem vertretbaren Verhältnis steht und ggfs. vor einem nachfolgenden Check-in auch nicht schaffbar wäre. Ein Reinigungsaufwand über das normale Maß hinaus (über 2m² ODER mehr als 10 Teile, Gegenstände, Stellen, Positionen) würde daher pauschal immer mit Reinigungskosten von minimum 100€ berechnet werden. Wir möchten Irritationen, Mißverständnisse und Ölbäder vermeiden. Daher sprechen wir es vorab deutlich an. Für Ihr Verständnis bedanken wir uns im Voraus.

Sicherheit
Für alle Praktiken tragen Sie selbst die Verantwortung. Die Ausstattung ist bis zu einem Körpergewicht von 120kg ausgelegt. Für Schäden, die auf ein höheres Gewicht zurück zu führen sind, haftet der Gast. Für die Sicherheit unserer Gäste und des Apartments ist der Eingangsbereich außerhalb der Location CCTV-überwacht (videoüberwacht). Aufzeichnungen werden binnen 24 Stunden nach Abreise gelöscht.

Schäden/Diebstahl
Sicher kann auch mal etwas kaputt gehen. Meist ist leicht erkennbar, ob das an unsachgemäßer oder an zu starker Inanspruchnahme lag oder nicht. Nicht in Ordnung ist, wenn defektes Equipment einfach unter anderem Equipment dann „versteckt“ wird. Ehrlich währt da am längsten. Gleiches gilt für das Mitnehmen von Andenken und das „versehentliche“ Einpacken von unserer Ausstattung (auch aus der Küche) und dem Equipment. Die Häufigkeit ist uns einfach zu hoch geworden. Für uns ist das Diebstahl mit allen Konsequenzen. Eine tägliche Fotodokumentation erleichtert uns die Bestandsaufnahme.

Diskretion
Da wir um Diskretion für unsere Anwohner und auch für spätere Gäste bemüht sind, betreten und verlassen Sie das Apartment stets nur in "zivil". Vielen Dank dafür.

Rauchen
Bei uns brauchen sie zum Rauchen und Vapen nicht vor die Tür zu gehen. Der Extra-Raum zwischen Küche und einem der Haupträume ist dafür als Raucherbereich vorgesehen. Bitte lösen Sie nicht die Rauchmelder durch Rauchen in anderen Räumen aus. Sie tragen die Kosten für einen Feuerwehreinsatz; die Berliner Feuerwehr ist schnell vor Ort.

Bezahlung
Sie nehmen eine verbindliche Buchung vor. Als Preis wird ihnen immer der reine Übernachtungspreis angezeigt. Zu addieren sind jeweils Cleaningkosten, Kaution und gewählte Extras. Die ggfs. anfallende Citytax (Berliner Übernachtungssteuer) wird erst nach Abreise mit der Kaution verrechnet. Bitte beachten Sie in Ihrem eigenen Interesse die Zahlungsfristen (immer binnen maximal 2 Tagen) für die Anzahlung und ggfs. Restzahlung (Gutschrift bei uns spätestens bis 4 Wochen vor Anreise). Verspätete Zahlungseingänge berechtigen uns, einen Spätzahlerzuschlag i. H. v. 10€ zu berechnen. Ab der zweiten Zahlungserinnerung werden diese zusätzlich mit jeweils 10€ berechnet. Damit sollen Spassbucher und Kalenderblockierer reglementiert werden. Falsche Namensangaben bei der Buchung und unvollständige Zahlungen berechtigen uns, den Check-in zu verweigern.

Stornierungen
In dem unglücklichen Fall, dass Sie Ihren Aufenthalt stornieren müssen, beachten Sie bitte, dass die folgenden Stornoregeln gelten:

Ab 4 Wochen vor dem Anreisetag beträgt die Stornierungsgebühr 100% des Buchungspreises. Bei einer Stornierung mehr als 4 Wochen vor dem Anreisetag fällt eine Stornierungsgebühr in Höhe der Anzahlung an. Bei einer Umbuchung bis vier Wochen vor dem Anreisetag berechnen wir für 50% der Anzahlung für den Mehraufwand. Eine Umbuchung innerhalb von vier Wochen vor dem Anreisetag wird wie eine Stornierung und eine neue Buchung behandelt.

Manchmal ist man beim Reisen auch schlicht verhindert oder fremdbestimmt und muss eine gebuchte Reise absagen/stornieren. Im Falle von Krankheit ist da eine Reiserücktrittsversicherung von Vorteil. Um die Stornokosten abzudecken, gibt es u. a. im Internet eine Vielzahl von günstigen Angeboten zum Thema Reiserücktrittsversicherung. Wir empfehlen, eine solche Reiserücktrittversicherung abzuschließen. Die Stornierung muss schriftlich und von der Email-Adresse aus erfolgen, an die auch die Buchungsbestätigung ging. Bitte schicken Sie eine E-Mail an info@bdsm-loft.com. Dazu bitte den Namen, den Buchungszeitraum und die Buchungsnummer angeben. Wir (Gastgeber) behalten uns ein besonderes Sonderstornierungsrecht einer bestehenden Buchung vor. Dafür müssen im Einzelfall besondere Gründe (z. B. ein Wasser- oder Feuerschaden, die Beendigung des Geschäftsbetriebs oder vom Gastgeber nicht zu vertretende Gründe) vorliegen. In diesem besonderen Fall erhält der Gast seine für die stornierte Buchung gezahlten Beträge selbstverständlich vollständig zurück.

Beim Check-out sind alle Lichter auszumachen und alle Fenster zu schließen. Denken Sie an den Brandschutz und an den Versicherungsschutz bei Einbrüchen. Bei Missachtung sind Sie in der Haftung.

Wir bitten um Ihr Verständnis, dass manche der vorstehenden Regeln erst aus Erfahrung entstanden sind und dadurch nötig wurden. Gleiches gilt für unser Equipment. Dieses wir vor jedem Gast auf Vollständigkeit und Funktionsfähigkeit geprüft und dokumentiert. Abweichungen in der Ausstattung sind ggfs. der Reparatur, dem Verlust oder der Verbesserung geschuldet.

Foto und Film
Fotos und Filme für Ihre privaten Zwecke sind natürlich möglich. Wenn Sie Ihre privaten Fotos und Filme in Foren etc. in jeglicher Art veröffentlichen, dann ist die Angabe unserer Domain „www.BDSM-Loft.com“ auf dem Foto Pflicht. Es reicht nicht aus, die Domain irgendwo neben dem Foto zu nennen. Gewerbliche Aufnahmen sind ausschließlich erst nach Absprache mit uns möglich.

Leider sind diese Regelungen jedoch nötig geworden. Unsere Intention ist jedoch immer, ihnen ihren Aufenthalt so angenehm wie möglich zu machen. Fragen sie uns, wenn sie Wünsche haben oder Informationen brauchen. Wir haben immer ein offenes Ohr für sie.

Terms and Conditions (Courtesy free translation)

You will find our terms and conditions below. You seldom want to read it, but we want to give you a brief, transparent overview of keywords. Most of the topics are certainly a matter of course and have only emerged from specific occasions. The terms and conditions cover the following topics: check-in and check-out,the unannounced guests, the very few not permitted topics, the extra cleaning effort (we will certainly never "be pernickety", but we would like to avoid repeating a few, very special incidents in the future), damage and theft as wellas smoking, the terms of payment and cancellations. Allow us a few clear words in order to avoid misunderstandings and to ensure a pleasant start to a great stay.

Check-in
Standard check-in is at 18.00 on your arrival day (not “anytime from 6 pm onwards "). Only with a written request is an early check-in at 15.00 bookable as well as a late check-in up to 21.00 with an individual time. Check-out on the day of your departure is up until the maximum check-out time and is spontaneous and flexible according to your choice.

Please note: we have no reception and we normally have other check-in appointments in other parts of Berlin on the same day and we have to leave again after 15 minutes. Therefore, your check-in explicitly takes place at the agreed time (fixed). Unscheduled waiting times and a second journey mean a significant and an additional amount of time. A new check-in time must then be agreed upon. For this, please ring the mobile phone number which is stated in the reservation confirmation and imprint. A second check-in time is charged with €25.

Berlin is very large. Therefore please plan your arrival, your train journey, your flight times, etc. in such a way that you can be at the check-in punctually and on time. Differing and late arrival times on public transport usually given in advance and not only on the day of arrival. Please kindly consider this for your train and flight bookings as well as for your route by car. Delayed arrival times by car can be registered via navigation apps in advance and not just at check-in time. Thank you for your understanding in this matter.

Guests
Non-registered guests are: A change of guests, multiple persons and visitors (also only temporary) are not permitted in the apartment. Unannounced guests (whether "just to say hello", "just looking" or "just popping in to see guests or only for a drink" or overnight etc.) will be charged per calendar day per person 150€. We absolutely do not desire any persons/people who have not already been included with the booking registration or who have not been additionally requested before the actual check-in takes place (Registration of extra guests after entering the apartment location is too late and not acceptable. Multiple persons cannot be re-registered. Unregistered persons entitle us to enter the location without advanced notification and exercise our house right. Our house rights mean to enter the location and exercise our rights.

The same is applicable, for persons who recieve a house ban. For persons with a house ban, it is not permitted to enter the location. If this does occur, we have the right to exercise our house right and will enter the location. We have the right to deliver a house ban and/or further house bans for the booking guests and his/her companions with immediate effect. In such an event, there will be no entitlement to a refund for the booking. The guest who is booking, who knows his/her companions, has the sole responsibility to ensure that his/her companions do not have an exsisting house ban.

We kindly bring to your attention, that infringements against a house ban are legally a criminal offense which are taken as trespassing and carry further consequences.

No persons are allowed entry under the age of 18, no subletting, no third party or private events or parties are allowed. The BDSM-Loft is not a location for Prostitution. Initiation, implementation of, acceptance or receiving of sexual services are not permitted on the location (vgl.ProstSchG §2). In case of any violation of this rule, the owners have the right to enter the location and exercise our house right.

Practices
Safety and hygiene are of the utmost importance to us and to our next guests. In a few specific cases, a heavy amount of cleaning is not justifiable for us. Therefore, we expressly forbid the use of wax /candles, pets, drugs, wet play (urine), pee (urine), squirting and coprophilia / known as scat or caviar. People under the age of 18 are strictly not allowed. Any non-compliance will be charged at € 200 and is non-negotiable!

Additional cleaning
In the kitchen and the civilian bedroom at the rear of the apartment, no oil or gel of any kind may be used (not on the floor, e.g. through footprints or on the bed). In all other rooms, the total amount of contamination should be less than 2 square meters (e.g. on the jailhouse fuck bed, the sling mat and the floor). Equipment and other items (e.g. masks, shackles, doors, shelves, furniture) should be individual cases of a maximum of 10 items. Unfortunately, we must raise awareness of this, as otherwise the normal cleaning effort would no longer be reasonable, and it might not be possible before a subsequent check-in. An additional cleaning effort beyond the normal amount (over 2m² OR more than 10 parts, objects, places, positions) would therefore always be charged with additional cleaning costs of minimum 100 €. We want to avoid confusion, misunderstandings, and large oil slicks. Therefore, we address this clearly in advance. We thank you in advance for your understanding.

Additionally, please also respect our non-smoking guests. Smoke only in the designated smoking area. Non adherence to these conditions will result in costs of 200€ and is non-negotiable!

Safety
During your stay, you are responsible for all practices that you partake in. The equipment is designed for a body weight of up to of 120kg. For any damages which can be traced back to a higher weight than recommended, the guest is liable. For the safety of our guests and the apartment, the entrance area outside of the location is CCTV-monitored (video-monitored). Recordings are deleted within 24 hours of departure.

Damage/Theft
We realise that naturally somethings can break. It is usually easy to see whether this was due to improper or excessive use or not. Please note that any defective equipment is not to be simply "hidden" and put back amongst the other equipment. Just let us know as simple honesty in this matter is very much appreciated. The same applies to the taking of souvenirs and the "accidental" packing of our equipment (also from the kitchen. Unfortunately, the frequency of this has become too high for us and any theft will be dealt with all its consequences. A daily photo documentation of all equipment allows us to facilitate the stocktaking of our inventory.

Discretion
For reasons of discretion for our neighbours and also for future guests, we kindly remind you that entering and leaving the apartment is only allowed in civil clothing. Thank you for your understanding in this matter.

Smoking
At the BDSM-Loft you don´t need to stand outside to smoke or to vape. The designated area for smoking is the room between the kitchen and the main room and is only permitted in this area. Please do not smoke in other areas of the apartment as this will set off the networked fire alarms. Please do not trigger the automatic smoke detectors by smoking, Vaping or using incense sticks in other rooms. For the case of a fire service operation the guest will cover the costs. The Berlin fire department is quickly on location. Thank you for your understanding.

Payment
When you book, you make a binding booking. The price you always see is the pure room rate. Cleaning costs, deposit and selected extras are always additionally added. The incurred City Tax (Berlin accommodation tax) will be charged only after departure and taken from the deposit. In your own interest, please kindly be aware of the payment deadlines (always within a maximum of 2 days) for the deposit and any remaining payment (on our account 4 weeks before arrival at latest). Delayed incoming payments and outstanding payment will carry a 10€ surcharge. From the second payment reminder, there will be an additionally charge of 10 € per reminder. This is intended to hinder those who book just for fun and block the calendar. False name information given at the time of booking and incomplete payments entitles us to refuse a check-in.

Cancellations
In the unfortunate event that you have to cancel your stay, please note that the following cancellation fees apply: 4 weeks before your arrival date that cancellation fees are 100%. With a cancellation more than 4 weeks before your arrival date, your down payment is used as the cancellation fee. For a re-booking up to 4 weeks before your arrival date, 50% of your down payment goes towards administration costs. A re-booking within 4 weeks of your arrival date will be treated as a cancellation and processed as a new booking.

Sometimes, life gets in the way of our plans through third parties or illness, therefore cancellation insurance is advisable. In order to cover cancellation costs, there are a number of insurance agencies online with inexpensive offers who specialise in cancellation insurance. The cancellation is to be sent via email to (info@bdsm-loft.com) from the email account from which the booking request was made. Please include your name, booking ID number and the dates of your booking. We (the hosts) reserve the right to cancel any current booking with special reason, e.g. water or fire damage, insolvency or other reason. In the case of such a special situation, the guest will naturally be reimbursed the payment for the cancelled dates.

At check-out, please kindly turn off all the lights and close all the windows. Please bear in mind fire protection and insurance coverage for burglaries. If you disregard these regulations, you could be liable.

We ask for your kind understanding that some of the above rules have arisen from experience and have become necessary. The same applies to our equipment. This is checked and documented for completeness and functionality before and after each guest. Deviations in the equipment may be due to repair, loss or improvement.

Photos and Film

Photos and films for your own private use are of course possible. If you publish your private photos and films in forums etc. in any way, then the specification of our domain "www.BDSM-Loft.com" on the photo is required. It's not enough to just name the domain anywhere near the photo. Commercial recordings are only possible after consultation and contact with us.

Unfortunately, these regulations have become necessary. However, our intention is always to make your stay as comfortable and pleasant as possible. Ask us if you have any wishes or need information. We always have an open ear for you.
